NC House Overrides Governor Stein’s Veto Of HB 805

RALEIGH – Today (Tuesday), the NC House voted to override Governor Stein’s veto of HB 805 on a 72-48 vote. Democrat Representative Nasif Majeed joined the majority to vote for the override.

HB 805 is pro-family legislation that reaffirms the biological reality of sex, protects girls in sleeping quarters in K-12 schools, strengthens protections for women and children from exploitation through online pornography, safeguards parental rights in education by giving them a religious opt-out of instruction and transparency and an opt-out for library books, ensures that taxpayer dollars are not used to fund irreversible sex-transition procedures, allows victims of harmful gender transition procedures 10 years to sue for the harm caused, and requires birth certificates to reflect the truth about a person’s sex.

“We applaud the NC House for taking this needed and common-sense step to protect vulnerable North Carolinians and reaffirm parental rights in our state,” said NC Values Coalition Executive Director Tami Fitzgerald. “NC needed to define two sexes by biology in the law so that women are not robbed of safety, dignity, and opportunities. We needed to stop public schools from forcing girls to share sleeping quarters with boys. We needed to give victims of experimental medical and surgical gender transition interventions a path to justice for their injuries instead of leaving them in the cold. We needed to stop women and girls from being exploited by the online porn industry. And we needed to give parents the ability to opt-out of educational materials that conflict with their beliefs and protect their children from exposure to sexually explicit content in schools. We would like to thank the General Assembly for taking bold action this session to ensure that families in our state have the best conditions to thrive and flourish.”

Key Provisions of HB 805 Include:

• Defining Biological Sex
  • The bill creates a legal definition of sex based on biology, not gender identity. This is in line with President Trump’s Executive Order, “Defending Women From Gender Ideology Extremism and Restoring Biological Truth to the Federal Government.”
• Protecting NC Girls in Private Spaces
  • Boys and girls in K-12 schools are prohibited from sharing the same sleeping quarters.
• Improving Birth Certificate Integrity
  • Any amended birth certificate reflecting a sex change must be issued as a multi-page document that includes the original birth certificate and its biological sex designation.
• Protecting Women and Minors from Sexual Exploitation
  • New standards are established for online platforms to verify the age and consent of all individuals appearing in pornographic content. Platforms that fail to comply face steep penalties.
• Restricting State Funds for Sex-Transition Procedures
  • Effective July 1, 2025, state funds may not be used—directly or indirectly—for sex-transition surgeries, puberty blockers, or cross-sex hormones for inmates.
• Upholding Parental Rights in Education
  • HB 805 ensures parents can opt their children out of instructional materials that conflict with their religious beliefs. It also mandates that school library catalogs be online, accessible, and searchable by parents and students alike and offers parents the right to identify library books that may not be borrowed by their student.
• Protecting Victims of Medical Gender Transition Interventions
  • Extends the statute of limitations for suing a doctor for harmful gender transition procedures to 10 years from the date of discovery.
